A Federal Capital Territory FCT High Court has issued an interim order allowing acting national secretary of the ruling All Progressives Congress APC, Victor Giadom, to act as the party’s national chairman.
Justice Samira Bature of the FCT high court gave the order on Monday following an ex-parte motion filed by the party’s national vice chairman, north-east, Mustapha Salihu.
Salihu had filed an application requesting the court allow Giadom to act as national chairman and preside over the party’s National Executive Council NEC meeting pending the decision of the party’s NEC.
He also sought an order restraining the APC and its officers or anyone from preventing Giadom from functioning as the acting chairman pending the hearing of the motion on notice.
Justice Bature however granted all the requests by the applicant and adjourned the matter to Friday, March 20.
This however coincides with a three-man panel of the Court of Appeal sitting in Abuja, led by Justice Abubakar Yahaya, on Monday, ordering a stay of execution of the FCT High Court’s order on the 4th of March suspending the national chairman, Adams Oshiomhole.
The appellate court ruled that the order would remain binding pending the hearing of Oshiomhole’s motion for interlocutory injunction slated for Friday the 13th of March while also directing the respondents, including the Police and the Department of State Services DSS to further restrain from giving effect to the FCT High Court suspension order.
It remains to be seen what orders would take effects in the ruling APC party following the numerous court rulings.
