A Court of Appeal sitting in Abuja has affirmed Senator Ifeanyi Ubah as lawmaker representing Anambra South Senatorial District at the National Assembly.
Justice Stephen Adah, leading a three-man panel of the appellate court, on Thursday set aside the judgment of the FCT High Court following the motion filed by Ubah challenging the judgement of the lower court on the grounds of improper filing of the suit and that the originating summons was not signed by any counsel as required by law.
Delivering the judgement, Justice Adah, held that the motion had merit and that the law makes it mandatory for a legal practitioner to sign an originating summons before it is issued out.
He said; “A document that is not signed is a worthless piece of paper and has no credibility.”
The judge therefore set aside the lower court judgement, declaring it a nullity.
Recall that Justice Bello Kawu, of the Federal Capital Territory FCT High Court in Abuja had on January 17 ordered the removal of Ubah on the grounds that he presented a forged National Examination Council NECO certificate to the Independent National Electoral Commission INEC.
