The Federal High Court in Lagos has fixed Tuesday, June 2 to hear an application by Senator Orji Uzor Kalu, a former Abia State Governor, seeking his release from prison.
The motion on notice will be heard by Justice Mohammed Liman.
The Abia North Senatorial representative had, in his application filed on Tuesday May 12, asked the court to order his release from the custody of the Nigerian Correctional Service NCS, Kuje, Abuja, following the nullification of his conviction by the supreme court.
Recall that Kalu, his firm, Slok Nigeria Limited, and former Director of Finance in Abia State, Jones Udeogu were in December convicted and sentenced by Justice Mohammed Idris of the Federal High Court in Lagos for a N7.1bn fraud.
But the supreme court on Friday, May 8, set aside the appeal of his co-defendant, Udeogu on the grounds that the trial judge, Justice Mohammed Liman, was no longer a judge of the Federal High Court as at the time he sat and delivered the judgment that convicted the defendants for allegedly stealing about N7.1bn from Abia State treasury.
The former Abia State governor who has now appealed his own conviction would get his own judgment separately.
